Terms of Service
1. Agreement Overview
This agreement represents the entire understanding between Ritual Photography (“Photographer”) and the client (“Client”) and supersedes all prior discussions and agreements. Any modifications must be made in writing and signed by both parties.
2. Payment & Booking Policy
A 50% non-refundable retainer is due at the time of booking to secure the session date and time. The remaining balance is due by the session date unless otherwise agreed. Pricing is locked in at the time of booking. Photographer will not hold or guarantee any date without the retainer.
3. Rescheduling & Cancellations
Clients may reschedule with a minimum of 14 days' notice. Client agrees to cover any travel or rescheduling costs incurred by Photographer. In the event of severe or unsafe weather as determined by Photographer, the session will be rescheduled at no additional cost.
4. Artistic Rights
Client acknowledges that they have reviewed the Photographer’s portfolio and are satisfied with the artistic style. Photographer retains full creative control and makes all final decisions regarding editing, composition, and image delivery. Specific shots are not guaranteed.
5. Image Delivery & Online Gallery
Client will receive a password-protected gallery within four (4) weeks of the session. The gallery will remain active for two (2) weeks for viewing and download. A $25 fee applies for reactivation of expired galleries.
Client is responsible for safeguarding their gallery login credentials. Photographer is not liable for unauthorized access.
6. Conduct & Liability
Client agrees to cooperate and communicate respectfully. Photographer is not responsible for missed moments due to non-cooperation. Photographer may terminate a session if there is a threat to safety, with no refunds provided. Client is financially responsible for any damage caused to equipment or studio space.
Client agrees to hold Photographer harmless for any injuries or damages incurred before, during, or after the session.
7. Copyright & Usage
Ritual Photography retains full copyright to all images. A limited-use license is granted to the Client for personal use and self-promotion. Commercial use or third-party publication requires prior written consent.
Photographer reserves the right to use images for marketing, advertising, and portfolio purposes unless otherwise agreed in writing.
Unauthorized reproduction, distribution, or modification of images is a violation of U.S. copyright law.
8. Limitation of Liability
In the unlikely event Photographer cannot fulfill services due to emergency, illness, or events beyond control, liability is limited to a refund of the retainer. Photographer is not liable for damages due to equipment failure, data loss, or unforeseen events. In all cases, liability shall not exceed the total amount paid by the Client.
Breathwork & Energy Healing Services
9. Acknowledgement & Risk
Client acknowledges that breathwork and energy healing are powerful, experiential practices involving emotional and physical release. These services are not substitutes for professional medical, psychological, or legal advice.
Client agrees to consult with a licensed healthcare provider regarding any pre-existing conditions. Participation is voluntary, and Client assumes all responsibility for their physical, emotional, and mental well-being.
10. Liability Waiver
Client waives and releases Ritual Photography and its representatives from any claims, liabilities, injuries, or damages arising from participation in healing or creative services.
11. Independent Decision-Making
Client agrees that all decisions made before, during, or after services are their sole responsibility and acknowledges that they are not under medical or legal instruction from Ritual Photography.
General Provisions
12. Non-Disparagement
Client agrees to maintain professional and respectful communication and will not publicly defame or disparage Ritual Photography or its representatives.
13. Termination
Photographer reserves the right to terminate services without refund if Client is uncooperative, disruptive, or violates the terms of this agreement.
14. Indemnification
Client agrees to indemnify and hold harmless Ritual Photography and its agents from all claims, damages, or expenses arising from participation in services or use of materials provided.
15. Dispute Resolution
Disputes shall first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration through the American Arbitration Association, governed by Washington State law. Claims must be filed within 100 days of the incident.
16. Governing Law
This agreement shall be governed by the laws of the State of Washington. All notices shall be delivered in person or by email.
BY PURCHASING THIS SERVICE, THE PARTICIPANT HAS READ AND AGREES TO THE WORKING AGREEMENTS ABOVE.
